Guideline on Application of Vessel Line Handling Service Available for Private Enterprise

1. Commencement area of vessel line handling service containing inbound, outbound and shifting vessels at the dock or securing to buoy into Port of Kaohsiung waterway.
2. Service Approach: free venture without partition.
3. Enterprise shall refer to the Service Fee Table (Business Services > Business Info > Tariff of Port Charges > Taiwan Kaohsiung Harbor Tariff of Port Charges - Including An-ping Port) for fees of each vessel scale and charge shipping agencies.
4. Procedure of the service available for private enterprise is as follow:
   (1) Private enterprise shall provide relevant documents and apply the service to Port of Kaohsiung Taiwan International Ports Corporation, LTD. (hereinafter referred to as "the branch office").
   (2) The branch office shall review and approve above application.
   (3) Private enterprise approved to establish shall submit relevant documents to the branch office for review and survey in three months (application for an extension is acceptable). The branch office shall reply date of commencement, and send copies to shipping companies, agencies and pilot association.
5. Enterprise approved for the service shall pay following fees to the branch office:
   (1) Management Fee: NTD 480 per operation. Every enterprise operating vessel line handling service shall pay the fee based on numbers of operation in one month (shifting operations shall be regarded as two operations). Management Fee shall be NTD 154 per operation for inbound and outbound operations in Wharves No. 1-10 and No. 50-58. The lowest amount of Management Fee shall be NTD 192,000 as monthly operation number does not reach 400 (business tax is not included).
   (2) Dockage: NTD 129.6 for one mooring boat per day, and a month shall be regarded as one term. Payment to the branch office shall be made every three terms.
6. Application requirements for operating vessel line handling service:
   (1) Registered capital: NTD 20 million and above.
   (2) Business location: applicants shall contain permanent establishment.
   (3) Occupational category shall limit to the service similar to the one below (the service shall be approved by the branch office or shown on certificate of incorporation and business registration certificate):
   a. Vessel operating carrier
   b. Tugboat
   c. Shuttle
   d. Vessel repair
   e. Labor venture
   f. Vessel line handling
   g. Water replenishment
   h. Vessel cargo handling venture
   (4) Minimum equipment requirements:
   a. Three or more self-owned mooring boats inspected, measured and qualified by shipping administration authority, and available to operate into Port of Kaohsiung waterway with gross tonnage above 8 tons and below 20 tons, main engine above 160 horsepower, and maximum capacity above 6 people. Engaged mooring boats go beyond three (self-owned or rental) shall also comply with the above requirement.
   b. Two self-owned vehicles with displacement is 2000cc and above. Vehicles in the front and rear must contain tow hooks for towing ropes (relevant identification documents are required).
   c. One fixed harbor craft radiophone (25 watts) for communication between dock man and pilot, and portable harbor craft radiophones (5 watts) same with the total amount of mooring boats, vehicles and above. (The branch office shall assist enterprise to assign communication manufacturer for applying radio station establishment permit letter and dealing with radio station import. Enterprise shall bear all charges. Equipment shall destroy under supervision according to The Telecommunications Act at the time of cease operation.)
   d. Operators shall not less than 18 people, and management shall hire additional dock man temporarily depending on workload. (Management shall submit employee list to Harbor Craft Center, Harbor Management Department of the branch office for future reference.)
7. Required documents for applying establishment of vessel line handling service:
   (1) Application Form (see Annex 2)
   (2) Company and business identification documents
   (3) Articles of incorporation (not necessary for unincorporated enterprise)
   (4) List of shareholders or list of directors and supervisors (not necessary for sole proprietor)
   (5) Business plan
   a. Description of business objectives
   b. Analysis of investment benefit (including financial sources and estimates of revenue & expenditure)
   c. List of equipment (including documents for sources of self-owned vessels & cars, and letter of authorization for applying radiotelephone & installation plan issuing by the enterprise)
   d. Approach of management and staffing
   (6) Business registration certificate
   (7) The copy of payment certificate for the latest business tax. If the enterprise cannot submit above certificate, it could be replaced by the previous period document. A startup company which the first period business tax is not due shall replace the certificate by approval of establishment registration issuing by the competent authority of business tax and application form for uniform invoice purchase certificate.
8. Approved enterprise shall submit equipment list to the branch office for review and investigation in three months (application for an extension is acceptable). The branch office shall inform conformity parties and provide Operational Call Sign for the Radiophone (see Annex 1).
9. Approved enterprise for the service shall settle following matters and submit relevant documents to the branch office. Approved enterprise shall operate the service at a specific date assigned by the branch office.
   (1) Signing 13 copies of Regulation for Port of Kaohsiung Vessel Line Handling Service (see Annex 3) with 2 original and 11 duplicate documents. One original and 9 duplicate documents shall be sent to the branch office.
   (2) Paying performance bond with a total amount of NTD 8 million (performance bond shall refund without interest at the time of cease operation and no outstanding issues).
   (3) Affiliated crew members and liners shall insure labor and health insurance, and casualty insurance amount at least NTD 2 million per person (enterprise shall send a duplicate document to the branch office).
10. The branch office shall cease the service as operation number doesn’t reach 400 per month for six consecutive months. The branch office shall refund performance bond without interest when there is no any outstanding issue.
11. The enterprise shall inform the branch office three months before cease operation. The branch office shall refund performance bond without interest when there is no any outstanding issue.
12. The enterprise shall comply with The Commercial Port Law, The Law of Ships, Labor Standards Act, Occupational Safety and Health Act, Environmental Protection Law, The Regulations on Port Services at Commercial Ports, The Seafarer Act, Small Vessel Management Regulations, Regulations on Seafarers of Small Vessel Management, Regulations on Port of Kaohsiung Vessel Line Handling Service and others.
13. The branch office shall make a public announcement and entertain a proposal at any time after approval of the Guideline.
